Protecting Your Assets and Your Children

A prenuptial agreement is a document you sign prior to marriage that defines how assets will be divided if the marriage fails or if either party dies. This agreement can lead to a division of assets that is outside of the usual outcome under Ohio law. A prenuptial agreement can be used to protect property you already own, as well as income and property you expect to have in the future. It can also be used to determine spousal support.

If you have children from a prior marriage, your prenuptial agreement can include a waiver of your spouse's right to inherit under your will. By including this waiver in your will, you can protect your children's right to inherit under your will if you should die before your spouse.

Are Prenuptial Agreements Enforceable?

Premarital agreements are enforceable in Ohio as long as:

  • You fully disclose your assets and debts
  • No pressure is placed upon the other party to sign the agreement
