Obtaining a Domestic Violence Restraining Order
Many abuse victims are afraid to call police or anyone else for help. However, you don't have to live in fear of violence.
You can obtain a temporary domestic violence restraining order by filing a petition with the court and attending a preliminary hearing. Your spouse does not have to be present at this hearing. The judge can provide you temporary protection based on your testimony alone.
The subject of a restraining order would be restrained from your home, barred from possessing firearms, restrained from communicating with you, or from coming within 500 feet of you. Anyone who violates a domestic violence restraining order would face jail time and serious criminal charges.
The temporary restraining order would be effective for a limited period of time. The court will schedule a full hearing to determine whether the temporary order should become permanent. The accused would have a right to attend the full hearing and provide a defense.
